Welcome to PassionalAI. Please read these Terms of Service ("Terms") carefully before using our website, AI-powered learning tools, and subscription services.

These Terms constitute an agreement between you and Chizsa Lee Ibañez, acting in her personal capacity as the individual founder and operator of PassionalAI in the Philippines ("PassionalAI," "we," "us," or "our").

These Terms apply exclusively to https://passionalai.com (the "Service") and do not govern other Chizsaleei products or websites.

By expressly accepting these Terms through the required acknowledgment process, you agree to be bound by them. If you do not agree, you must not access features that require acceptance.

1. About PassionalAI

PassionalAI is an AI-powered educational platform designed to support independent learning, language development, communication skills, and personalized practice.

Depending on your subscription and feature availability, the Service may include:

Teach Me: AI-generated lessons, explanations, educational materials, and guided learning.

Interactive Practice: Personalized exercises, conversations, scenarios, and performance feedback.

IELTS Preparation: Speaking, writing, listening, and reading practice, simulated examinations, and educational performance analysis.

Medical and Professional English: Communication exercises, simulated clinical scenarios, and professional language training.

Voice Learning: Speech recognition, transcription, pronunciation assistance, audio playback, and AI-generated voice responses.

AI Learning Coaches: Personalized guidance and feedback through supported virtual coaches.

Learning Progress: Saved lessons, learning history, performance insights, and review activities.

Family Plans: Shared subscription benefits and credit allowances for eligible adult learners.

Specific features, usage limits, availability, and entitlements may vary depending on your plan, device, geographic location, and service configuration.

PassionalAI supplements independent study and professional instruction. It does not guarantee examination success, academic qualifications, employment, or any particular learning outcome.

2. Eligibility and Accounts

PassionalAI's AI-powered learning services are available only to individuals aged 18 years or older.

This requirement applies to registered users, guest previews, individual subscribers, Family members, and additional learner profiles.

To use the Service, you must:

Be at least 18 years old and legally capable of accepting these Terms.

Provide accurate registration and account information.

Keep your credentials secure.

Use only accounts and learner profiles you are authorized to access.

Personally complete the required legal acknowledgment process.

Comply with these Terms and applicable laws.

Parental or guardian permission does not override the minimum age requirement.

Before accessing AI-powered features, users must review the applicable published Terms and Privacy Policy, agree to the Terms, acknowledge the Privacy Policy, and confirm adult eligibility.

Signing in with Google or another authentication provider does not automatically constitute acceptance of these Terms or verification of age.

PassionalAI may restrict AI access when required acknowledgment is missing, outdated, revoked, or inconsistent with known eligibility information.

Existing users may be required to review updated Terms before continuing to access AI-powered features. Declining revised Terms does not automatically delete an account, cancel an existing subscription, or waive applicable consumer or privacy rights.

3. AI-Generated Content and Educational Responsibility

PassionalAI uses artificial intelligence to generate lessons, explanations, exercises, simulated conversations, feedback, and educational assessments.

AI-generated content may contain inaccuracies, omissions, inconsistencies, or unsuitable recommendations.

You acknowledge that:

AI responses may not always be factually accurate or complete.

Educational scores and performance assessments are estimates, not official examination results.

Generated explanations should be evaluated using appropriate learning materials and reliable sources.

Responses may vary depending on the submitted information, selected features, AI models, and provider availability.

You remain responsible for interpreting and using the information provided.

PassionalAI does not guarantee the accuracy, originality, completeness, or suitability of every AI-generated response.

Users should exercise independent judgment and seek appropriately qualified assistance when necessary.

4. Medical, Clinical, and Professional Education

PassionalAI may provide medical English, patient-communication exercises, fictional clinical scenarios, and professional examination preparation.

These features are intended exclusively for language learning and non-clinical educational purposes.

The Service must not be used for:

Diagnosing or treating real patients.

Prescribing medications.

Making clinical or emergency-care decisions.

Replacing qualified medical advice.

Processing identifiable patient records through AI learning activities.

Making consequential professional decisions without appropriate human review.

PassionalAI is not a medical device, healthcare provider, or substitute for licensed professionals.

Likewise, the Service does not provide personalized legal, financial, psychological, employment, or other regulated professional advice.

5. Subscriptions, Plans, and Payments

PassionalAI may offer free previews, paid subscriptions, promotional access, and credit-based features.

The applicable checkout information specifies the price, currency, billing period, included benefits, usage limits, and relevant taxes or charges.

Subscription billing

Paid plans provide access according to their stated subscription terms.

Automatically renewing subscriptions continue until canceled unless the applicable checkout terms state otherwise. A one-time credit-pack purchase does not itself create a recurring subscription.

Users may cancel future renewals through available Billing controls or the relevant payment-provider process.

Paid access generally continues until the end of the current billing period unless affected by an applicable refund, reversal, termination, or legal requirement.

Plan allowances and entitlements are governed by the disclosures applicable to the relevant purchase.

Deleting an account does not necessarily cancel an externally managed subscription. Users should cancel subscription renewal separately.

Payments and refunds

Payments are processed through supported third-party payment providers.

PassionalAI does not store complete payment-card credentials.

Refunds, billing corrections, cancellations, and payment disputes are subject to the applicable checkout commitments, published Refund Policy, and mandatory consumer-protection laws.

Nothing in these Terms excludes or restricts consumer rights that cannot legally be waived.

6. AI Credits and Usage Allowances

Certain PassionalAI features use AI credits or other usage allowances.

Credit consumption may vary according to the selected feature, processing requirements, and applicable plan.

Where supported:

Subscription plans include specified credit allowances.

Family plans may provide shared credit pools.

Purchased or promotional credits may carry separately disclosed conditions.

Credit reservations may occur while AI requests are being processed.

Final charges, adjustments, or releases follow the applicable usage and settlement rules.

Failed or interrupted requests may have different credit outcomes depending on the processing stage and applicable rules.

PassionalAI maintains usage-accounting safeguards intended to prevent duplicate charges for the same operation. Pending provider work must be resolved before its credit reservation can be safely settled. Closing a page, signing out, timing out or losing a connection does not establish that an already dispatched provider request was canceled. Such work may still complete and requires safe reconciliation. Retrying does not authorize a second charge for the same operation.

Users may report suspected incorrect credit deductions or billing discrepancies through our support contact.

We may investigate and correct verified errors where appropriate.

7. Family Accounts and Shared Access

Family subscriptions, where available, allow eligible adult users to share certain subscription benefits and usage allowances.

Every person accessing AI-powered learning must independently satisfy adult eligibility and acknowledgment requirements.

Acceptance by a Family subscription owner does not automatically constitute acceptance by another member.

Separate authenticated accounts maintain their own access permissions.

However, additional learner profiles used under a shared sign-in may be accessible to anyone who controls that account. Such profiles should not be assumed to be private from the account holder.

Users must not share accounts to circumvent eligibility, security, privacy, or subscription restrictions.

8. User Content and Uploaded Materials

You retain the rights you hold in original content submitted to PassionalAI, including written responses, recordings, documents, and learning materials.

You grant PassionalAI a limited, non-exclusive permission to store, host, process, transcribe, analyze, and display submitted content as reasonably necessary to deliver, maintain, secure, and support the features you request.

Processing may involve authorized AI, speech, cloud, and storage providers as described in our Privacy Policy.

You must ensure that you have the necessary rights and permissions to submit any content.

You must not submit:

Materials that infringe intellectual-property rights.

Unlawfully obtained or unauthorized confidential information.

Identifiable patient records.

Another person's personal information without appropriate authorization.

Malicious files or materials intended to compromise the Service.

Content intended for unlawful, fraudulent, abusive, or harmful purposes.

Acknowledging the Privacy Policy does not automatically grant permission for optional marketing, tracking, or unrelated uses of personal information.

Where separate consent or another legal authorization is necessary, it must be obtained appropriately.

9. Privacy and Personal Information

PassionalAI processes account information, learning materials, voice recordings, transcripts, subscription details, usage records, and relevant technical information to provide and maintain the Service.

Our collection, use, sharing, retention, and protection of personal information are described in the Privacy Policy.

Depending on applicable law, users may request access, correction, deletion, or other actions concerning their personal information.

Privacy requests may be submitted to founder@chizsaleei.com.

Authorized PassionalAI administrators handle these requests under the responsibility of the individual operator.

We may require reasonable verification of identity or account ownership before disclosing, modifying, exporting, or deleting personal information.

Certain information may be retained when necessary or permitted for lawful financial, security, contractual, dispute-resolution, or regulatory purposes.

Deletion of information from active systems does not necessarily result in immediate deletion of every backup or third-party provider copy.

10. Acceptable Use and Security

You agree to use PassionalAI responsibly and in accordance with applicable laws.

You must not:

Access another person's account or information without authorization.

Circumvent age, consent, authentication, payment, or security restrictions.

Conduct unauthorized security testing, exploitation, or interference.

Overload, disrupt, or intentionally impair the Service.

Engage in payment fraud or unauthorized transactions.

Upload malicious software or infringing content.

Use generated material to facilitate unlawful activities or harm.

Present AI-generated assessments as official qualifications or professional certifications.

Use automated agents to accept legal agreements or make consequential commitments for another person without appropriate authorization and explicit human confirmation.

PassionalAI may investigate suspected violations and proportionately restrict or suspend access when reasonably necessary to protect users, service integrity, security, or legal compliance.

11. Intellectual Property

PassionalAI's software, interfaces, branding, original learning workflows, platform design, and other protected materials belong to the operator or their respective licensors.

Subject to these Terms and your applicable subscription, you receive a limited, personal, non-exclusive, non-transferable right to access and use the Service.

You do not acquire ownership of the platform or its protected content.

You retain your rights in original submitted materials.

Rights in AI-generated content depend on applicable laws, third-party rights, and the nature of the material.

Generated content may resemble material provided to other users and may not qualify for exclusive intellectual-property protection.

12. Service Availability and Modifications

PassionalAI aims to provide reliable educational services, but uninterrupted or error-free operation cannot be guaranteed.

Availability may be affected by:

Internet connectivity and device compatibility.

Cloud infrastructure and third-party service availability.

AI or speech-provider capacity.

Subscription and credit limitations.

Maintenance, security updates, or technical interruptions.

We may improve, modify, suspend, or discontinue features when reasonably necessary.

Where practical and legally required, we will provide appropriate notice of material changes affecting paid subscriptions.

Such changes remain subject to applicable contractual commitments and mandatory consumer rights.

13. Account Closure, Subscription Cancellation, and Data Deletion

You may stop using PassionalAI at any time.

You may request account closure or personal-data deletion through available account controls or the official support email.

Account deletion, subscription cancellation, and comprehensive personal-data deletion are separate processes.

The current self-service account-deletion function removes the Firebase Authentication identity. It does not, by itself, establish deletion of all associated learning records, uploaded materials, recordings, financial records, legal acknowledgment records, backups, or provider-held copies.

Authorized administrators will review requests, verify identity or authority as appropriate, and assess applicable technical capabilities and lawful retention requirements.

If you have an active subscription billed through an external payment provider, you should cancel future renewals separately.

Account termination does not eliminate rights or obligations that lawfully continue after access ends.

14. Disclaimers and Limitations of Liability

PassionalAI provides educational software and AI-generated learning assistance.

We do not guarantee:

Uninterrupted service availability.

Error-free or completely accurate AI responses.

Particular educational or examination results.

Professional qualifications or certifications.

Continuous availability of third-party technologies.

To the extent permitted by applicable law, the Service is provided on an "as available" basis, subject to any express commitments in the applicable purchase or subscription agreement.

Any limitation or exclusion of liability applies only where legally permitted.

Nothing in these Terms excludes mandatory consumer remedies, statutory privacy rights, or liability that cannot lawfully be excluded.

15. Complaints and Dispute Resolution

If you have concerns regarding account access, learning services, subscriptions, payments, refunds, or these Terms, please contact founder@chizsaleei.com.

We will review complaints through our applicable support procedures and seek a reasonable resolution.

These Terms are governed by the laws of the Philippines, subject to applicable mandatory consumer, privacy, and other non-waivable legal protections.

Nothing in these Terms prevents users from exercising rights or pursuing remedies available under applicable law.

16. Changes to These Terms

We may update these Terms to reflect service improvements, subscription changes, provider requirements, security measures, or applicable legal obligations.

The current published version and effective date will be available on this page.

Material changes may require users to review and expressly accept revised Terms before continuing to access AI-powered learning features.

We will not treat silence, ordinary account login, or an automated action as a substitute for an acknowledgment that users are required to make personally.

Prior published versions and relevant acceptance records may be retained where appropriate for legal, security, or accountability purposes.

Updates will not retroactively remove mandatory legal rights or override binding purchase commitments.
